Notice of Privacy Practices
THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
Our duties to you
Your health information is personal, and we are committed to protecting it. The law requires us to:
- keep the privacy of your protected health information, meaning information that identifies you and relates to your health, your care or payment for your care
- give you this notice of our legal duties and privacy practices
- follow the terms of the notice currently in effect
- notify you if a breach occurs that may have compromised the privacy or security of your information
We will not use or share your information other than as described here unless you tell us we can in writing.
How we use and share your information
We may use and share your information without your written authorization for the following purposes.
Treatment
We use your information to provide and coordinate your care, and we share it with other professionals who are treating you. For example, a nurse practitioner may share your lab results with the physician who oversees your plan, or send a prescription to the pharmacy you choose.
Payment
We use and share your information to bill and collect payment for the services you receive. For example, we may share the details needed to set up a payment plan you have applied for, or give you a receipt you can submit to a health savings account. If you pay for a service in full yourself, you can ask us not to share information about it with a health plan, and we will agree unless the law requires otherwise.
Health care operations
We use and share your information to run our wellness center, improve your care and contact you when needed. For example, we may review records to check the quality of care, train staff, or use companies that help us run the clinic.
Business associates
Some services are provided for us by companies called business associates, such as our electronic health record and scheduling system. We share only what they need to do the work, and they are required to protect your information.
Appointment reminders and health-related services
We may contact you by phone, text or email to remind you of appointments, follow up on your care, or tell you about treatment options and services we offer that may interest you.
People involved in your care
Unless you object, we may share information with a family member, friend or other person you identify who is involved in your care or helps pay for it. If you are not present or cannot agree, for example in an emergency, we will use our professional judgment about what is in your best interest. We may also share information with disaster relief organizations so your family can be told where you are and how you are doing.
Other ways we may share your information
The law allows or requires us to share your information in the following ways, usually to contribute to the public good. We have to meet many conditions in the law before we can share it for these purposes.
- As required by law: when federal, state or local law requires it, including to the U.S. Department of Health and Human Services if it wants to see that we are complying with federal privacy law.
- Public health and safety: to prevent disease, report adverse reactions to medications or problems with products, help with product recalls, report suspected abuse, neglect or domestic violence as the law requires, and prevent or reduce a serious threat to anyone's health or safety.
- Health oversight: to agencies for activities the law authorizes, such as audits, investigations, inspections and licensing.
- Lawsuits and legal actions: in response to a court or administrative order, or to a subpoena or other lawful request, subject to the protections the law requires.
- Law enforcement: for law enforcement purposes the law permits, such as responding to a court order or helping identify a suspect or missing person.
- Coroners, medical examiners and funeral directors: as needed for them to carry out their duties.
- Organ and tissue donation: to organizations that handle organ, eye or tissue donation.
- Research: for research that has been approved through a process that protects your privacy.
- Workers' compensation: for workers' compensation claims, as the law allows.
- Special government functions: for military, national security and presidential protective services, and to correctional institutions or law enforcement officials with lawful custody of you.
Where Nevada law gives your information more protection than federal law, we follow the more protective rule.
Information shared outside the wellness center
Once we share information as this notice allows, the person or organization that receives it may not be covered by federal privacy law and could share it again.
Substance use disorder treatment records
If we receive records from a federally assisted substance use disorder treatment program, or testimony describing their content, they will not be used or shared in any civil, criminal, administrative or legislative proceeding against you unless you give written consent, or a court orders it after you have been given notice and a chance to be heard, as 42 CFR part 2 requires. A court order must be accompanied by a subpoena or other legal requirement compelling the disclosure.
Your rights
You have the following rights over your health information. To use any of them, contact our Privacy Officer using the details at the end of this notice. Some requests must be in writing, and we will help you with the form.
See and get a copy of your records
You can ask to see or get an electronic or paper copy of your medical and billing records. We will respond within 30 days, and may charge a reasonable, cost-based fee. In limited cases we may deny your request, and we will tell you why in writing and how to ask for a review.
Ask us to correct your records
You can ask us to correct information you think is wrong or incomplete. We may say no, but we will tell you why in writing within 60 days, and you can submit a statement of disagreement.
Ask for confidential communications
You can ask us to contact you in a particular way, such as by a certain phone number or email, or to send mail to a different address. We will agree to all reasonable requests.
Ask us to limit what we use or share
You can ask us not to use or share certain information for treatment, payment or our operations. We are not required to agree, and we may say no if it would affect your care. If you pay for a service or item in full out of pocket, you can ask us not to share that information with your health plan for payment or operations, and we will agree unless the law requires us to share it.
Get a list of those with whom we have shared information
You can ask for a list, called an accounting, of the times we have shared your information in the six years before your request, who we shared it with and why. It will not include disclosures for treatment, payment and operations, or ones you asked us to make. We provide one list a year free and may charge a reasonable, cost-based fee for more.
Get a copy of this notice
You can ask for a paper copy of this notice at any time, even if you agreed to receive it electronically. We will give it to you promptly. It is also posted at our wellness center.
Choose someone to act for you
If you have given someone medical power of attorney, or someone is your legal guardian, that person can exercise your rights and make choices about your health information. We will confirm the person has that authority before we act.
Changes to this notice
We can change the terms of this notice, and the changes will apply to all the information we have about you, including information we created or received before the change. The new notice will be available on request, in our wellness center and on this website, with its new effective date.
Complaints
If you believe your privacy rights have been violated, you can file a complaint with us by contacting our Privacy Officer using the details below.
You can also file a complaint with the U.S. Department of Health and Human Services Office for Civil Rights by writing to 200 Independence Avenue, S.W., Washington, D.C. 20201, calling 1-877-696-6775, or visiting www.hhs.gov/ocr/complaints.
We will not retaliate against you in any way for filing a complaint.
